Witness signatures
Does Kudocs allow documents to be signed electronically with a witness? Yes. You can use Kudocs to get any document that is generated in Kudocs that needs a witness signature, signed & witnessed. This includes, share certificates with a director and witness, any deeds (e.g. deed of adherence, deed of waiver), etc.
How does Kudocs manage the witness process? Our understanding of the law around witnessed documents is that the witness needs to be present to witness the signature. It is no good (e.g.) emailing some one to witness a signature when they never actually saw it happen! That is why Kudocs requires a witness to countersign the same device as the main signatory. i.e. they need to be in the same place! We have a 60 second timer for the witness to add their signature, to ensure that they are actually there. If you don’t countersign within 60 seconds it does not matter. The main signature is deleted and you can just start again. Very easy. Kudocs also tracks metadata (IP address and Geolocation) as additional information in case evidence is ever needed that the witness actually witnessed the signature!
